The Ministry of Justice have set up a new Claims Management Anonymous Reporting Hotline on 0333 200 0110. This is specifically to allow individuals and businesses to report details of alleged malpractice, fraudulent activity, rule breaches or poor service in confidence and anonymously.
The Ministry of Justice have also issued a reminder that claims management companies are not permitted to make cold calls to individuals where the intention is to refer any accident claims to a solicitor. A claims management company cannot deal with an accident or personal injury compensation claim as they are not legally qualified to do so and have to pass the claim on to a personal injury lawyer or solicitor. The solicitor cannot accept an accident claim referral that resulted from a cold call as this would breach the Solicitors’ Code of Conduct. Solicitors cannot accept claims from an unregulated claims management company.
